These Terms of Service ("Terms") govern your use of the ChoiceFoundry website and your purchase of the ChoiceFoundry Online Business Audit and any related services ("Services"). ChoiceFoundry ("we", "us", "our") operates from Australia. These Terms are governed by the laws of the Australian state or territory in which ChoiceFoundry is based.
1. What we provide
The Online Business Audit is a one-time, fixed-price strategy product. It includes a tailored analysis of your current online business or presence, classification across the Customer, Offer, Discovery, Conversion and Execution areas, identification of one primary growth constraint, prioritised recommendations, a 30-day action plan and a Day 0 baseline measurement framework.
The audit is a document and set of recommendations. It is not a managed implementation service. Unless separately agreed in writing, we do not build, run, post, advertise or otherwise implement anything on your behalf.
2. Nature of the advice
Our Services consist of general business strategy and marketing analysis based on the information you provide and publicly available information about your online presence. Our recommendations are opinions and suggestions intended to help you make clearer decisions. You remain responsible for deciding whether and how to act on them.
We do not provide legal, tax, accounting, financial-product, investment, credit, insurance or other regulated professional advice. Nothing in our Services should be relied upon as such. Where your decisions may have legal, tax, financial or regulatory consequences, you should obtain advice from an appropriately qualified professional.
3. No guarantee of outcomes
Business results depend on many factors outside our control, including your execution, market conditions, platform algorithms, competition and timing. We do not guarantee any particular revenue, profit, sales, customer, follower, engagement, ranking or other commercial outcome, and any examples or projections are illustrative only.
4. Your responsibilities
- Provide accurate, reasonably complete information so we can prepare your audit.
- Only share information you are entitled to share, and avoid third-party personal information where not necessary.
- Provide only business and financial information relevant to the assessment — approximate figures or ranges are acceptable where exact amounts are not needed.
- Never submit passwords, payment-card or bank login credentials, Tax File Numbers or other government identifiers, or unrelated sensitive personal information.
- Ensure your business and its activities comply with applicable laws and platform rules.
- Use the audit for your own business. Do not resell or redistribute it.
5. Price, payment and delivery
The Online Business Audit is priced at AUD $129 as a one-time payment, unless otherwise stated at checkout. Prices are in Australian dollars and, where applicable, inclusive of GST. Payment is processed by a third-party payment provider and is due before work commences. Expected delivery timing is confirmed during checkout or onboarding, and depends on you supplying the information we request.
6. Refunds, cancellations and the Australian Consumer Law
Our Services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms limits those rights.
If you change your mind after purchasing but before we have begun personalised analysis of your business, contact us as soon as possible. Where no personalised work has commenced, we may cancel the engagement and provide a refund.
Because the audit is a bespoke service, once we have begun personalised analysis or preparation of your audit we do not otherwise offer refunds solely because you change your mind, decide not to continue, no longer require the service, or choose not to implement the recommendations.
If you believe the audit has not been delivered with due care and skill or does not match its description, contact us at hello@thechoicefoundry.com and we will review the circumstances and, where appropriate, work to rectify the issue or provide another appropriate remedy. A lack of improvement in revenue, sales, customers, followers, reach or another metric does not by itself establish that the service was defective.
7. Intellectual property
We retain ownership of our frameworks, templates, methods and website content. On payment, you receive a non-exclusive, perpetual licence to use your audit and its recommendations for your own business. Information you provide remains yours; you grant us a licence to use it only for the purpose of delivering the Services.
8. Confidentiality
We will keep the business information you provide confidential and will not disclose it except to service providers who assist us in delivering the Services, or as required by law. We may describe our work in anonymised, non-identifying terms.
9. Limitation of liability
To the maximum extent permitted by law, and subject to any non-excludable rights you have under the Australian Consumer Law, our total liability arising out of or in connection with the Services is limited to the amount you paid for the relevant Service, or to re-supplying the Service, at our election. We are not liable for indirect or consequential loss, including loss of profit, revenue, data or opportunity.
10. Website use
Our website is provided on an "as is" basis. We aim to keep it accurate and available but do not guarantee that it will be error-free or uninterrupted. Links to third-party sites are provided for convenience and do not imply endorsement.
11. Changes to these Terms
We may update these Terms from time to time. The version published on this page at the time of your purchase applies to that purchase.
